How long does the Ireland Intra-Company Visa last for?
The duration of the permit depends on the reason for the transfer. Persons transferring to an Irish branch for the purpose of training will only be allowed a permit for a maximum of 12 months. Other permits may be granted for a maximum period of up to 24 months for the first application and may be extended upon application to a maximum stay of five years.
Is the position of the employee/transferee in the company important for the application?
Yes. The employee in question must be crucial to the running of the company and must fall into one of the categories of senior management, key personnel or trainee.
For this Ireland visa application, senior management is considered to be someone who:
Manages the organisation, department, subdivision, function or component of the organisation.
Supervises or controls the work of other supervisory, professional or managerial employees, or manages an essential function within the organisation, or a department or subdivision of the organisation.
Has the authority to hire and fire or recommend these, as well as other personnel actions (such as promotion and leave authorisation) OR if no other employee is directly supervised, function at a senior level within the organisation hierarchy or with respect to the function managed and,
Exercises discretion over everyday operations of the activity or function for which the employee has the authority.
For this visa application, ‘key personnel’ is considered to be someone who has special knowledge in the establishment's service, research equipment, techniques and management.
In assessing such knowledge, high level of qualification or prior experience will be taken into account.
Trainees will be considered for an Intra-Company Transfer Permit for a maximum of 12 months, provided it can be adequately demonstrated that a detailed training program will be in place.
Can the employee/transferee switch employments while in Ireland?
No. The employee/transferee cannot work for any employer other than that named in the Irish Company Work Permit. When the employment finishes or when the permit expires the employee/transferee must return to their country of origin.
Is there a limit on the number of Intra-Company Transfers into the host organisation?
Normally the number of Intra-Company Transferees should not exceed 5% of the total Irish workforce in a firm, although in exceptional circumstances such as small firms or start-up companies a higher Intra-Company percentage may be permitted on a strictly temporary basis with an absolute limit of 50% of non-EEA staff.
